1.    Course description:

‘Laying the Foundations to Reading and Writing Success – Beginners course’ is a holistic training programme designed for parents/caregivers of children aged 2.5 – 6 years of age. 

 1.1   This course combines knowledge of 1. parenting skills, 2. understanding your child as a learner, 3. the knowledge and understanding of the explicit skills needed to effectively teach your child to read and write using the Rooted in Sounds system and 4. how to complete summative assessments of the progress made by your child. 

 1.2   We provide you with a comprehensive toolkit of 14 recorded lessons.  There are a series of downloadable resources, a parent workbook, lesson plans, pupil workbooks, alliteration cards, letter sound order chart, letter sound cards, consonant cluster cards, a word bank, decodable words, phrase strips, decodable readers, and thorny words. Children's workbooks, activities to consolidate learning and a monitoring and evaluation document.

 1.3   You have 1 year (365 days) access to the course content from the time of purchase.  The course can be purchased from https://rootedinsounds.com/ made available via the Thinkific platform.

1.4   The course structure includes -

Module 1 - Preparing you to teach - 3 lessons – Parental Support, Role Modelling and Concepts of Print

Module 2 - Your child as a learner - 3 lessons – Your Child, Self Esteem and Motivation

Module 3 - Training you to effectively teach your child to read and write - 7 lessons – Getting Started, Language and Vocabulary and Word Meaning, Language Comprehension and Mark Making, Phonological and Phonemic Awareness and Letter Sound/Alphabet Knowledge, Phonics and Handwriting, Fluency and Spelling, Reading Comprehension and Grammar and Assessment

Module 4 - Assessment - 1 lesson

1.5   There are activities throughout the parental workbook that are provided to help you to get the maximum benefit from the course, by supporting you to reflect and process the content.  The activities are provided for your own reflection.  The course is delivered in English and you are expected to have an intermediate understanding of the English language to participate in the course content.  The skills of reading and writing are delivered in a practical way, modelled through the recorded lessons.

 

 2.    Payment and refund policy:

 2.1   The course can be paid for on the Thinkific page for Rooted in Sounds Limited  via credit/debit card. 

 2.2   Fees for the Service selected by you on the Website shall be debited from your credit / debit card at the time of purchase. 

  2.3   Fees must be paid in full prior to you accessing any Online Course.   

 2.4   Any fees charged by your debit or credit card provider in connection with your purchase of Services are for your own account and Rooted in Sounds shall not be responsible for these. You shall be responsible for all costs you incur in connection with your access onto any Online Course.

  2.5   A legally binding agreement between us and you shall come into existence when we have:(a) accepted your offer to purchase Services from us by sending you an email confirming the purchase; and (b) received payment of the relevant Fees from you in accordance with clause 2.1 above. 

 2.6   Each individual course will be treated by us as a separate offer to purchase.  Acceptance of your offer to buy one or more courses will not be acceptance by us of your offer to purchase any other courses which make up your order.

  2.7   Where we have accepted/confirmed the Services being purchased/received by you and formed a legally binding agreement with you in accordance with clause 2.6 above, then you are permitted within 14 working days starting on the day after the date we have concluded our agreement in accordance with clause 2.5, to cancel your purchase of the Services. 

 2.8   If you have purchased an Online Course and have already accessed, downloaded all or part of the Online Course and/or started to use that Online Course then you shall have no right to cancel your order, this supersedes clause 2.7 above

 2.9   Notwithstanding clause 2,7 there is no other right to cancel or vary your purchase of Services and any other cancellation will be at the entire discretion of Rooted in Sounds.

 

3.    Access and availability:

You can access your online course materials, through the website, https://rootedinsounds.com/ via the Thinkific platform.

3.1   You will require an internet connection, browser, https://rootedinsounds.com/ and device from which to view and download resources, including the pdf parent workbook, resources for teaching and a pupil workbook. Here is a list of the System Requirements and Supported Browsers from Thinkific

  3.2    As the course is available through a learning platform separate to Rooted in Sounds, we cannot be held responsible for any scheduled or unscheduled maintenance or downtime that may affect their access to the course, Laying the Foundations to Reading and Writing Success – Beginners Course.

 

4.    Intellectual property and license:

 4.1   All Intellectual Property Rights in the Online Course, Presentations and the speeches made by trainers during webinars remain, the intellectual property of Rooted in Sounds or its licensors, whether adapted, written for or customised for the Client or not.

 4.2   You are not authorised to:-

(i) copy, modify, reproduce, re-publish, sub-licence, sell, upload, broadcast, post, transmit or distribute any of the Course Materials without prior written permission;

(ii) record on video or audio tape, relay by videophone or other means the Online Course, Presentation or webinar given

(iii) use the Course Materials in the provision of any other course or training whether given by us or any third-party trainer;

(iv) remove any copyright or other notice of Rooted in Sounds on the Course Materials;

(v) modify, adapt, merge, translate, disassemble, decompile, reverse engineer (save to the extent permitted by law) any software forming part of the Online Courses.

4.3   Breach by you of this clause 4.2 shall allow us to immediately terminate these terms and conditions with you and cease to provide you with any Services, including but not limited to access to the Online Courses.

4.4   In consideration of the Fees paid by you, we grant to you a limited, non-transferable, non-exclusive licence to use the Course Materials and the software in respect of the Online Course for the sole purpose of completing the Online Course for a period of 1 year (365 days)  from the date of purchase.


5.    Privacy and data protection:

 5.1   The nature of the Services provided by us means that we will obtain, Use, and disclose (together "Use") certain information about you ("Data"). This statement sets out the principles governing our Use of Data. By purchasing the Services, you agree to this use.

 5.2   When you register with us you will need to provide certain Data such as your contact details and demographic information. We will store this Data and use it to contact you, provide you with details of the Services you have purchased and otherwise as required during the normal provision of the course.  We will not pass any personal data onto anyone outside of Rooted in Sounds.

 5.3   Our products may link to third party websites and we are not responsible for their data policies or procedures or their content.

 5.4   Rooted in Sounds endeavour to take all reasonable steps to protect your personal Data including the use of encryption technology, but cannot guarantee the security of any Data you disclose. You accept the inherent security implications of being and transacting on-line over the internet and will not hold us responsible for any breach of security.

 5.5   If you wish to change or update the data we hold about you, please e-mail [email protected].  You should also comply with any applicable laws and regulations on privacy and data protection in your jurisdiction.

 

6.     Liability

6.1. No part of the provision of the Services shall be deemed to be, nor is it intended to be, nor should it be taken to be, the provision of investment advice.

6.2. Although Rooted in Sounds aims to provide the Services to the highest standards of the industry, neither it, nor its trainers accept any liability for (i) any inaccuracy or misleading information provided in the programmes or Course Materials and any reliance by Client on any such information, (ii) any loss or corruption of data, (iii) any loss of profit, revenue or goodwill, or (iv) any indirect, special or consequential loss arising from any breach of the terms of this Agreement.

6.3. Except to the extent that they are expressly set out in this contract and conditions, no conditions, warranties or other terms shall apply to the Services.  Subject to clause 6.5 no implied conditions, warranties or other terms apply (including any implied terms as to satisfactory quality, fitness for purpose or conformance with description).

6.4. Subject to clause 6.5 below, Rooted in Sounds total liability arising from or in connection with this contract and in relation to anything which we may have done or not done in connection with this contract and the delivery of the Service (and whether the liability arises because of breach of contract, negligence or for any other reason) shall be limited to the Fees received by us in connection with the relevant Online Course in relation to which a dispute has arisen.

6.5. Nothing in this Agreement shall exclude or limit Rooted in Sounds liability for (i) death or personal injury caused by negligence, (ii) fraudulent misrepresentation or (iii) any other matter which under English law may not be limited or excluded.

6.6. No claim may be brought more than three months after the last date on which the Services concerned have finished or ceased to be provided by us.


7.    Dispute resolution:

7.1   If a dispute arises between a participant and Rooted in Sounds, regarding the online course, in the first instance, notify Rooted in Sounds via email [email protected].  All complaints will be handled within 72 hours.  Do provide up-to-date contact information and outline the complaint/dispute.  If the dispute is not resolved to your satisfaction, then do refer to clause 7.2 below.

 7.2   Any dispute arising out of or in connection with this contract, including any question regarding its existence, validity or termination, shall be referred to and finally resolved by arbitration under the LCIA Rules, which Rules are deemed to be incorporated by reference into this clause. The number of arbitrators shall be one. The seat, or legal place, of arbitration shall be London, England. The language to be used in the arbitral proceedings shall be English. The governing law of this contract shall be the substantive law of England and Wales.
